Article 1: ORGANIZER
The competition is organized and presented by: Cosmetic code doo, Puškarićeva ulica 18, 10250 Lučko (Zagreb), Republic of Croatia. OIB: 68361104551 (hereinafter: Organizer).
Article 2: DURATION, PURPOSE AND VENUE OF THE PRIZE COMPETITION
The "Win a MNLY 2-in-1 Beard Product" competition (hereinafter: the Competition) is conducted for the purpose of promoting the Organizer on its official Instagram page mnly.eu (hereinafter: mnly.eu).
The competition runs from December 22, 2020, from 9 p.m. to December 29, 2020, until 10 p.m., and applies to the territory of the Republic of Croatia.
The person who applies to participate in the Competition is hereinafter referred to as the Participant. The Competition is in no way affiliated with, sponsored or promoted by any social network mentioned in these rules.
Article 3: PROMOTION AREA
All information about the Competition will be available on the official website www.mnly.hr.
Article 4: RIGHT TO PARTICIPATE
The right to participate in the Competition is open to all natural persons residing in the Republic of Croatia, over 18 years of age on the date of the start of this Competition, except for employees of the Organizer and members of their immediate families (parents, sisters and brothers, spouses, children), as well as all other persons who participated in the preparation of this Competition.
Article 5: HOW TO PARTICIPATE IN THE PRIZE COMPETITION
The goal of the Competition is for the Participant to design and write a creative advertising slogan for the product MNLY 2-in-1 aftershave and day cream in a comment on mnly.eu.
The Organizer will not have access to the user's data, except for those data that are publicly available on the social network Instagram. Any use of false or duplicate profiles or reasonable suspicion of their existence will be sanctioned by eliminating the Participant from the Competition. The Organizer cannot know which personal data will be transferred to social networks, nor in what way and to what extent such data will be used by the same or third parties. The Participant is recommended to familiarize himself with the data protection rules on the aforementioned social networks.
Article 6: SELECTION OF THE WINNER
The winners will be the three Contest Participants who, as selected by the expert jury, offered the most creative solutions to the assigned task.
The names of the award winners will be published in accordance with the provisions of Article 15 of these Rules.
Article 7: PRIZE FUND DETERMINED BY THE ORGANIZER
The prize fund consists of:
Three 2-in-1 aftershave and day cream products from the MNLY brand.
One Participant can only win the prize once.
Article 8: HOW TO COLLECT THE PRIZE
After the Competition ends, the MNLY team will notify the winner of the prize via Instagram story and in the comment on the prize post.
The prize cannot be exchanged for money or transferred to another person. The prize delivery deadline is 20 days from the day the winner is announced.
Article 9: PARTICIPANTS IN THE PRIZE COMPETITION
Participants participating in the Competition may not claim a prize in larger quantities or a different prize than that specified in these Rules by the Organizer. By participating in this Competition, Participants accept these Rules.
The Organizer will review all responses received and reserves the right to disqualify registered Participants at any time if:
violate the Rules;
do not respond to the Organizer's inquiry within 24 hours or leave incorrect personal information or for some other reason it is not possible to contact them;
do not adhere to the theme of the Competition;
the content they publish has an offensive or vulgar connotation, public figures are mentioned or the text represents content that is not in accordance with the law.
Article 10: ERRORS AND IRREGULAR APPLICATIONS
Incorrect or incomplete entries are invalid and forfeit any prize. Multiple entries with the same email or home address will be considered one winner. If a Contest Participant enters any inappropriate or offensive content, it will be removed and will not be considered a valid entry for the Contest.
Article 11: PUBLICITY
By participating in this Competition, Participants agree that their contribution to the Instagram Competition may be published and used by the Organizer for marketing purposes free of charge, in printed, audio, visual or video material, exclusively, irrevocably in time and territory in all media.
This Competition is in no way affiliated with Instagram, Instagram does not promote or sponsor it. The data is provided solely for the purposes of the full functionality of this Competition to Cosmetic code doo, not Instagram. Instagram is a public platform and the publication of any content (including photos) may constitute an invasion of privacy, both of the Competition Participants themselves and of third parties. If the Competition Participants publish any content under the Instagram post with the Competition, it will be considered that they published it voluntarily and Instagram is not responsible for the content thereof, as well as for the misuse of such content by any third parties. It will also be considered that, if the Participants publish any content under the Instagram post with the Competition (including photos, text messages, comments, any personal data, etc.), they have all necessary authorizations to publish such content. By such publication, Participants grant Cosmetic code doo permission to use all published content for marketing and any other commercial purposes and at the same time waive all material and any other rights they may have on that basis.
Article 12: TYPES AND USE OF COLLECTED INFORMATION / DATA
By participating in this Competition, Participants agree that the Organizer collects, processes and publishes their personal data, as well as the personal data of the person to whom the prize will be sent, which Participants themselves provided in this Competition (such as name, address, e-mail address, city and telephone number), and uses the same for marketing and promotional purposes related to this Competition, exclusively and without territorial limitation, in all media. All personal data collected in connection with this Competition is kept by the Organizer for a period of one year from the date of the end of the Competition, unless the Participant himself requests the deletion of his own data.
The Participant has the right to withdraw their consent to the collection and processing of personal data at any time, but also accepts that such withdrawal may lead to the inability to participate in the Competition.
The organizer will use the personal data specified in paragraph 1 of this article for:
1. contacting the Participant to arrange prize delivery
2. delivery of the prize to the Participant.
Article 13: PARTICIPANTS' RIGHTS RELATED TO PERSONAL DATA
Contest participants, by sending an email to cosmetic.code.web@gmail.com, have the right to:
1. request access to personal data stored by the Organizer
2. request access to information on the purposes for which personal data prepared by the Organizer are used
3. request correction or addition of personal data stored by the Organizer
4. request the deletion of personal data stored by the Organizer
5. request the cessation of the processing of personal data if there is a reasonable suspicion that his data is not being processed in a defined manner
6. file an objection to the data collected and processed by the Organizer.
Article 14: PUBLICATION OF PERSONAL INFORMATION / DATA
The Organizer will not share personally identifiable information with other parties, but may share information about Participants with affiliated companies.
The organizer provides certain services through third parties. The third party carries out certain activities on behalf of the Organizer and for its account, such as the organization of the delivery of the Prize.
The Organizer is authorized to disclose personally identifiable information/data of Participants when it is reasonably expected that their disclosure will assist in law enforcement or is necessary as a result of a court order.
Article 15: ANNOUNCEMENT OF WINNERS
The winners will be announced in the comments below the post with the task on the official Instagram page mnly.eu, as well as on the Instagram story of the same profile. After the Competition ends, three winners will be announced.
Article 16: TAXES
The winner is not obligated to pay any taxes, duties or fees directly related to the prizes.
Article 17: IN THE EVENT OF A DISPUTE
In the event of a dispute between the Organizer and the Contest Participants, the Municipal Court in Zagreb shall have jurisdiction.
Article 18: POSSIBILITY OF INTERRUPTION OF THE PRIZE COMPETITION
The Organizer reserves the right to terminate the Competition in the event of circumstances for which the Organizer is not responsible, or which it could not prevent, eliminate or avoid, in which case it is released from all possible obligations towards the Participant. The Organizer bears no responsibility for technical problems or errors in data entry and other reasons beyond the Organizer's control. The Participant who participates in the Competition accepts the rights and obligations under the Rules. The Organizer reserves the right to change the Rules, of which all Participants will be notified in a timely manner on the Instagram page mnly.eu.
